Terms of Use

Pharmacy Tech Scholar℠ Terms of Use
Effective Date: May 28, 2026
Company: Emmel Enterprises, LLC d/b/a Pharmacy Tech Scholar℠, a Florida limited liability company
Contact: [email protected]

1. Agreement to these Terms

These Terms of Use (“Terms”) govern your access to and use of pharmacytechscholar.com, learn.pharmacytechscholar.com, the Pharmacy Tech Scholar℠ learning platform, online coursework, course materials, assessments, downloads, communications, support features, third-party resources made available through the platform, and any related services we provide (collectively, the “Services”).

By accessing the website, creating an account, purchasing course access, using the learning platform, clicking to accept these Terms, or using any part of the Services, you agree to these Terms. If you access the Services on behalf of an employer, education provider, association, workforce organization, or other sponsoring organization, you represent that you are authorized to use the Services under that arrangement.

These Terms apply to both the public website and the LMS. If a separate written agreement exists between Pharmacy Tech Scholar℠ and an Organization, that written agreement controls the relationship between Pharmacy Tech Scholar℠ and the Organization to the extent of a direct conflict. These Terms continue to govern individual user access unless the written agreement expressly states otherwise.

2. What Pharmacy Tech Scholar℠ Provides

Pharmacy Tech Scholar℠ provides access to an online PTCB-recognized pharmacy technician education/training course, related learning materials, platform access, progress tracking, assessments, optional learner support, and completion documentation where applicable.

Pharmacy Tech Scholar℠ is a course provider. Pharmacy Tech Scholar℠ is not a college, university, academy, career school, vocational school, proprietary school, occupational school, nonpublic postsecondary institution, credentialing body, licensing authority, employer, staffing agency, or job-placement provider.

The Services are provided as online coursework and related course-access services. Unless expressly stated in a separate written agreement, Pharmacy Tech Scholar℠ does not provide in-person instruction, clinical training, externships, internships, workplace supervision, job placement, employment services, or state licensure/registration services.

3. No Degree, Diploma, Academic Credit, License, Credential, Certification, or Job Placement

The Course does not award a degree, diploma, academic credit, academic transcript, license, state credential, occupational certification, employment qualification, or job placement.

PTCB certification is awarded only by PTCB after a separate application, verification, approval, and exam process. Completion of the Course does not guarantee PTCB application approval, exam authorization, exam passage, certification, licensure, registration, employment, promotion, salary, or eligibility to practice as a pharmacy technician in any state.

Any completion documentation issued by Pharmacy Tech Scholar℠ confirms course completion only. It does not itself authorize employment, licensure, registration, certification, or practice in any state, and it is not proof of state school approval, state authorization, institutional accreditation, or occupational certification.

4. PTCB Recognition and State Requirements

The Course is PTCB-recognized for the CPhT education/training pathway as of the applicable period of recognition. PTCB recognition is separate from state school authorization, state licensure, state registration, institutional accreditation, programmatic accreditation, employer hiring requirements, and state-specific pharmacy technician requirements.

State requirements and course availability may vary. You are responsible for reviewing requirements that may apply to your personal goals, including PTCB requirements, state requirements, employer requirements, and any licensure, registration, certification, supervision, or workplace requirements. Pharmacy Tech Scholar℠ does not provide legal advice, pharmacy-practice advice, licensure advice, or state-specific practice eligibility determinations through the Services.

Pharmacy Tech Scholar℠ may decline, limit, suspend, route, or condition access based on state availability, delivery model, Organization-sponsored access, partner arrangements, or other operational controls. You agree to provide accurate location and account information when requested. Misrepresenting your location, identity, or eligibility for access may result in suspension or termination.

5. Course Access Period

Unless a different access period is stated at checkout, in an order form, or in a separate written agreement, individual course access lasts for six months from the date of purchase or account activation, whichever is stated in the applicable order confirmation.

Course access is time-limited. Access may expire at the end of the applicable access period unless you purchase an optional renewal, receive sponsored access through an Organization, or Pharmacy Tech Scholar℠ extends access in writing.

Course access is personal to the assigned learner. You may not transfer, share, resell, sublicense, assign, or permit another person to use your account, course seat, login credentials, course materials, assessments, or completion documentation.

6. Optional Monthly Renewal

After the initial course access period, eligible learners may purchase an optional monthly renewal if offered. By purchasing a monthly renewal, you authorize Pharmacy Tech Scholar℠ or its payment processor to charge the disclosed renewal fee to your payment method on a recurring monthly basis until you cancel or until the renewal option is discontinued.

You may cancel a monthly renewal by using the cancellation feature in your account, if available, or by emailing [email protected] with “Cancel Renewal” in the subject line. Cancellation is effective at the end of the then-current billing period. Partial-month refunds or credits are not provided except where required by law or expressly approved by Pharmacy Tech Scholar℠.

Pharmacy Tech Scholar℠ may change renewal pricing or features by providing notice to the email address associated with your account. If you do not wish to continue under the changed pricing or terms, you must cancel before the change takes effect.

7. Payment, Course Access Fees, and Optional Third-Party Items

You agree to pay all fees disclosed at checkout, in an invoice, in an order form, or in a separate written agreement. Fees for individual users should be described as course access fees, optional renewal fees, optional voucher fees, or optional resource fees, not tuition.

Some purchase options may include optional PTCB exam application fee support, PTCB practice resources, third-party reference materials, or other third-party items. Third-party items may be subject to separate terms and availability. A voucher, practice resource, or third-party item does not guarantee PTCB eligibility, exam authorization, exam passage, certification, licensure, registration, employment, or any state-specific outcome.

Pharmacy Tech Scholar℠ may use third-party payment processors. You agree to provide accurate billing information and authorize charges to your selected payment method for the fees disclosed at checkout or in the applicable order.

8. Course Access Refund Policy

Except where required by law, stated in a separate written agreement, or expressly offered at checkout, individual course access fees are refundable only if all of the following are true:

  1. you request the refund within seven days after purchase;
  2. you have not completed the Course;
  3. no Course Completion Confirmation has been issued;
  4. you have not violated these Terms; and
  5. your access was not purchased through an Organization or bulk-license arrangement with separate terms.

Refund requests must be sent to [email protected] and must include the learner name, account email, purchase date, and reason for the request.

Optional PTCB vouchers, third-party resources, and practice resources are nonrefundable once issued, redeemed, activated, or otherwise made available to you, except where required by law or expressly stated in the applicable checkout terms.

Organization purchases, bulk licenses, sponsored seats, partner purchases, and invoice-based purchases are governed by the applicable written agreement, order form, invoice terms, or Organization policy.

9. Optional Exam-Result Support Benefit

If, and only if, a purchase option is expressly advertised at checkout as including an exam-result refund or renewal benefit, that benefit applies only according to the conditions stated in the checkout offer or order confirmation.

Unless the checkout offer states otherwise, the benefit applies only if the learner completes the Course within 180 days after purchase, receives a Course Completion Confirmation, takes the PTCE after completing the Course, does not pass the PTCE, and sends a copy of the unsuccessful exam-result notice to [email protected] within 365 days after the original purchase date. If eligible, the learner may elect either one additional 180-day course access period or a refund of the eligible course access fee, excluding any voucher, third-party resource, practice resource, processing, or non-course component.

This benefit is not a guarantee of exam passage, exam authorization, certification, licensure, registration, employment, or any other outcome. Pharmacy Tech Scholar℠ may deny the benefit for account sharing, identity misrepresentation, assessment misconduct, misuse of course materials, payment failure, chargeback, or other violation of these Terms.

10. Payment Disputes and Chargebacks

You agree to contact Pharmacy Tech Scholar℠ at [email protected] to attempt to resolve billing questions before initiating a payment dispute or chargeback.

A payment dispute, payment reversal, chargeback, failed payment, suspected fraud, or unauthorized transaction may result in suspension or termination of course access while the issue is reviewed. Pharmacy Tech Scholar℠ may withhold, correct, void, or decline to verify a Course Completion Confirmation if access was obtained without valid payment, through fraud, through account misuse, or in violation of these Terms.

A chargeback or payment dispute does not create a right to a refund outside the refund policy or applicable law.

11. Account Security and Accurate Information

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree not to share your login credentials or allow any other person to access the Services through your account.

You agree to provide accurate account, identity, location, and payment information and to keep that information current. Pharmacy Tech Scholar℠ may suspend or terminate access if it reasonably believes account information is inaccurate, misleading, fraudulent, or used to bypass state availability, account security, payment, or course integrity controls.

12. Learner Identity and Assessment Integrity

The Course is designed for individual learner completion. By accessing the Course, you represent that you are the person completing the coursework, modules, readings, quizzes, assessments, checks, and completion activities assigned to your account.

You agree that you will not:

  1. allow another person to complete any part of the Course on your behalf;
  2. complete any part of the Course on behalf of another person;
  3. use unauthorized assistance on assessments;
  4. share, solicit, sell, post, photograph, copy, reconstruct, or distribute assessment questions, answers, rationales, scoring logic, or performance analytics;
  5. use bots, scraping tools, screen capture tools, automated tools, or AI systems to complete assessments or reconstruct course content;
  6. misrepresent your identity, location, course progress, completion status, PTCB application information, or exam-related information; or
  7. submit false, misleading, altered, or fraudulent information to Pharmacy Tech Scholar℠, PTCB, an Organization, an employer, or any third party.

Pharmacy Tech Scholar℠ may suspend or terminate access, invalidate assessment results, withhold or void completion documentation, decline verification, notify a sponsoring Organization, and, where appropriate and permitted, report suspected identity fraud, assessment compromise, or PTCB-related misrepresentation to PTCB or another affected party.

13. Course Completion Confirmation

If you complete all required Course components and satisfy applicable completion requirements, Pharmacy Tech Scholar℠ may issue a Course Completion Confirmation.

A Course Completion Confirmation confirms completion of the Course only. It is not a degree, diploma, academic credit, academic transcript, license, state credential, occupational certification, guarantee of PTCB eligibility, guarantee of exam passage, employment qualification, proof of state school approval, or proof of state licensure/registration.

Pharmacy Tech Scholar℠ may correct, replace, withhold, void, or decline to verify completion documentation if it identifies error, payment failure, chargeback, account sharing, identity misrepresentation, assessment misconduct, misuse of materials, or other violation of these Terms.

14. Educational Content and Pharmacy-Practice Disclaimer

The Services are provided for educational and exam-preparation-related purposes. Course content is not medical advice, pharmacy-practice advice, legal advice, licensure advice, registration advice, workplace supervision, employer training, or a reference standard for pharmacy technician practice.

Pharmacy Tech Scholar℠ works to provide accurate and useful educational content, but healthcare information, pharmacy practice, laws, regulations, exam standards, employer policies, and state requirements may change. Pharmacy Tech Scholar℠ does not warrant that all content is complete, current, error-free, or applicable to any particular state, employer, workplace, exam attempt, drug product, patient situation, or practice setting.

Medication information, if included, is generalized for educational purposes and is not intended to provide complete drug information, clinical guidance, therapeutic recommendations, or patient-specific advice. Inclusion or omission of a medication or medication class is not an endorsement for or against any drug product, therapy, manufacturer, or use.

15. No Outcome Guarantees

Pharmacy Tech Scholar℠ does not guarantee:

  1. PTCB application approval;
  2. PTCE authorization;
  3. PTCE passage;
  4. PTCB certification;
  5. state licensure, registration, or approval;
  6. eligibility to practice as a pharmacy technician;
  7. employment, promotion, salary, or career advancement;
  8. employer acceptance of the Course;
  9. state board acceptance of the Course;
  10. availability in every state; or
  11. uninterrupted or error-free platform access.

Any testimonials, examples, learner experiences, pass references, or outcome statements, if used, are not guarantees and may not be typical.

16. Intellectual Property and Limited License

Subject to these Terms and your active course access period, Pharmacy Tech Scholar℠ grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and course materials solely for your individual educational use.

Pharmacy Tech Scholar℠ and its licensors own all rights, title, and interest in the Services and course materials, including text, video, audio, graphics, slides, downloads, assessments, questions, answer choices, rationales, explanations, scoring logic, curriculum structure, sequencing, organization, software, platform content, trademarks, logos, and related intellectual property.

You may not copy, reproduce, download except where expressly enabled, screen-record, scrape, extract, archive, modify, publish, transmit, distribute, display, perform, sell, resell, sublicense, create derivative works from, reverse engineer, benchmark, or otherwise exploit the Services or course materials except as expressly allowed in these Terms.

17. No Competitive Use; No Course-Based Derivatives

You may not use the Services, course materials, assessment materials, curriculum structure, sequence, explanations, examples, or related content to create, train, improve, benchmark, market, or support any course, curriculum, question bank, tutoring service, exam-preparation product, training product, AI model, dataset, or competing offering.

Nothing in this section prohibits you or an Organization from independently developing materials without use of or reference to Pharmacy Tech Scholar℠ materials.

18. Assessment Materials and Confidentiality

All assessments, questions, answer choices, rationales, scoring logic, progress data, and performance analytics are confidential and proprietary to Pharmacy Tech Scholar℠ or its licensors. You may not copy, photograph, transcribe, share, sell, post, upload, disclose, or create a database of assessment materials.

Posting course materials or assessment materials to public or private forums, study sites, file-sharing services, social media platforms, AI tools, or repositories—including Quizlet, Reddit, Discord, Chegg, Course Hero, GitHub, or similar services—is prohibited.

19. AI and Automated Tools

You may not upload, transmit, paste, or otherwise provide course materials, assessment materials, questions, answers, rationales, or proprietary explanations to any generative AI system, machine-learning system, dataset, tutoring bot, or automated analysis tool.

You may not use AI tools, bots, scripts, scraping tools, or automation to complete coursework, answer assessments, reconstruct course explanations, extract content, or bypass platform controls.

20. Group Display, Recording, and Sponsored Access

You may not display, broadcast, screen-share, record, rebroadcast, or present course materials to any person who does not have a current authorized course seat.

If access is provided through an Organization, the Organization is responsible for ensuring that each learner has an authorized seat unless a separate written agreement expressly permits a different delivery model. Live screen-sharing, training-room use, group facilitation, or classroom-style use is not permitted unless expressly authorized in writing by Pharmacy Tech Scholar℠ and must exclude assessment materials unless specifically approved.

21. Third-Party Content and Resources

The Services may include access to third-party websites, platforms, reference materials, practice resources, payment processors, LMS technology, voucher systems, or other third-party services. Third-party services are governed by their own terms and policies.

Where third-party reference content, including APhA PharmacyLibrary or similar resources, is made available, your use is subject to the applicable third-party license terms. You may not copy, systematically download, scrape, redistribute, sell, lend, modify, create derivative works from, or publicly distribute third-party content except as expressly allowed by the applicable third-party terms.

Pharmacy Tech Scholar℠ is not responsible for third-party content, availability, errors, interruptions, policy changes, or actions.

22. Communications and Support

You consent to receive notices, account messages, transactional emails, course access messages, platform notices, renewal notices, billing messages, and support communications electronically. Electronic communications satisfy any requirement that communications be in writing to the extent permitted by law.

Learners may submit course access, billing, technical, or content-related concerns to [email protected]. Pharmacy Tech Scholar℠ will review and respond under its support procedures. This support process does not create or imply state school approval, academic credit, licensure, registration, certification, or a school grievance process.

23. Community Features and User Submissions

The Services may include discussion, messaging, comments, support, or other communication features. You agree to use those features lawfully and respectfully.

You may not post or transmit content that is unlawful, defamatory, harassing, threatening, obscene, infringing, fraudulent, misleading, malicious, privacy-invasive, spam, advertising, solicitation, malware, or otherwise objectionable in Pharmacy Tech Scholar℠’s discretion. You also may not post assessment materials, proprietary course materials, personal information of others, or content that violates third-party rights.

You retain ownership of content you submit, but you grant Pharmacy Tech Scholar℠ a non-exclusive, worldwide, royalty-free license to use, host, reproduce, display, transmit, modify, and process your submissions as necessary to operate, provide, improve, protect, and support the Services. Pharmacy Tech Scholar℠ may remove submissions or restrict communication features at any time.

24. Organizational and Sponsored Access

If your access is sponsored, purchased, assigned, or managed by an Organization, the Organization may receive information about your account, access status, progress, completion status, support issues, and compliance with these Terms, subject to the applicable written agreement and privacy policy.

Unless a separate written agreement states otherwise, the Organization is responsible for learner selection, sponsorship decisions, local compliance, learner-facing disclosures, any fees charged by the Organization, refunds handled by the Organization, records maintained by the Organization, and any completion documentation the Organization chooses to issue under its own policies.

Organizations and their administrators may not describe Pharmacy Tech Scholar℠ as a school, academy, college, accredited institution, licensed school, state-approved provider, board-approved provider, certification provider, employment provider, or job-placement provider unless Pharmacy Tech Scholar℠ has approved the exact wording in writing.

25. Privacy

Your use of the Services is subject to the Pharmacy Tech Scholar℠ Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how Pharmacy Tech Scholar℠ collects, uses, shares, and protects information.

These Terms do not replace the Privacy Policy. The Privacy Policy should be maintained as a separate document and linked from the website, checkout flow, and LMS.

26. Children and Minors

The Services are not intended for children under 13, and Pharmacy Tech Scholar℠ does not knowingly collect personal information from children under 13. If you are under 18, you may use the Services only with permission and supervision of a parent or legal guardian, and the parent or legal guardian is responsible for your use of the Services.

27. Prohibited Uses

You may not use the Services:

  1. for any unlawful, fraudulent, misleading, abusive, or unauthorized purpose;
  2. to violate these Terms or third-party rights;
  3. to interfere with or disrupt the Services;
  4. to attempt unauthorized access to accounts, systems, data, or networks;
  5. to bypass state availability controls, payment controls, account controls, seat limits, or technical restrictions;
  6. to upload malware or harmful code;
  7. to harvest information about other users;
  8. to impersonate another person or entity;
  9. to misrepresent your identity, location, eligibility, progress, or completion status; or
  10. to make unauthorized claims about Pharmacy Tech Scholar℠, the Course, PTCB recognition, state approval, certification, employment, or outcomes.

28. Suspension and Termination

Pharmacy Tech Scholar℠ may suspend, restrict, or terminate your access at any time if you violate these Terms, fail to pay required fees, initiate an unresolved chargeback, misuse the Services, compromise assessment integrity, share account access, infringe intellectual property rights, provide inaccurate information, misuse completion documentation, or create legal, security, operational, or reputational risk.

Upon termination, your right to access the Services ends immediately. Sections concerning payment, refunds, intellectual property, assessment confidentiality, AI restrictions, completion documentation, disclaimers, liability limits, indemnification, dispute resolution, and miscellaneous terms survive termination.

29. Availability, Changes, and Errors

Pharmacy Tech Scholar℠ may update, modify, discontinue, suspend, replace, or remove any part of the Services, course materials, features, access methods, pricing, renewal options, third-party resources, or platform functionality at any time.

The Services may include typographical errors, technical errors, content errors, or interruptions. Pharmacy Tech Scholar℠ may correct errors, update content, change platform providers, or modify access processes without creating a refund right except as expressly stated in these Terms or required by law.

30. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Pharmacy Tech Scholar℠ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, uninterrupted access, error-free operation, exam outcome, certification outcome, employment outcome, licensure outcome, registration outcome, and state acceptance.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

31. Limitation of Liability

To the maximum extent permitted by law, Pharmacy Tech Scholar℠ and its owners, officers, directors, employees, contractors, licensors, vendors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or related to the Services or these Terms.

To the maximum extent permitted by law, Pharmacy Tech Scholar℠’s total liability for any claim arising out of or related to the Services or these Terms will not exceed the amount you paid to Pharmacy Tech Scholar℠ for individual course access during the six months before the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

32. Indemnification

You agree to indemnify, defend, and hold harmless Pharmacy Tech Scholar℠ and its owners, officers, directors, employees, contractors, licensors, vendors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  1. your use or misuse of the Services;
  2. your violation of these Terms;
  3. your violation of law or third-party rights;
  4. your submissions or communications;
  5. your account sharing or unauthorized use;
  6. your misuse of course materials, assessment materials, or completion documentation;
  7. your misrepresentation to Pharmacy Tech Scholar℠, PTCB, an Organization, an employer, a state authority, or any third party; or
  8. adverse consequences related to your work, attempted work, licensure, registration, certification, or practice as a pharmacy technician.

Pharmacy Tech Scholar℠ may assume control of the defense of any claim subject to indemnification, and you agree to cooperate.

33. Dispute Resolution; Informal Resolution First

Before filing a claim, you and Pharmacy Tech Scholar℠ agree to try to resolve the dispute informally. The party raising the dispute must send a written notice describing the dispute and requested relief. Notices to Pharmacy Tech Scholar℠ must be sent to [email protected] and to any physical mailing address listed in the applicable order confirmation or website legal notice.

The parties will have 30 days to attempt to resolve the dispute informally.

34. Arbitration and Class Action Waiver

Except for claims that may be brought in small claims court and claims seeking injunctive or equitable relief for intellectual property misuse, account misuse, assessment compromise, confidentiality breaches, or unauthorized use of the Services, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the Federal Arbitration Act.

The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider. The arbitrator will have authority to decide the scope and enforceability of this arbitration clause, except that any dispute about the class action waiver will be decided by a court of competent jurisdiction unless applicable law requires otherwise.

You and Pharmacy Tech Scholar℠ agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative proceeding. The arbitrator may not consolidate claims or preside over any class, collective, or representative proceeding unless both parties agree in writing.

35. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except to the extent federal law applies or applicable consumer law requires otherwise.

For any claim not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida, except where applicable law requires a different venue.

36. Changes to these Terms

Pharmacy Tech Scholar℠ may update these Terms from time to time. The updated Terms will be posted on the website or LMS with a revised effective date. Changes apply prospectively unless otherwise stated or required by law.

Continued use of the Services after updated Terms are posted or presented for acceptance means you accept the updated Terms. If you do not agree to updated Terms, you must stop using the Services and cancel any optional renewal.

37. Miscellaneous

These Terms, together with the Privacy Policy, applicable checkout terms, order confirmation, and any separate written agreement that expressly applies, form the agreement between you and Pharmacy Tech Scholar℠ regarding the Services.

If any part of these Terms is found unenforceable, the remaining parts remain in effect. Pharmacy Tech Scholar℠’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations without Pharmacy Tech Scholar℠’s written consent. Pharmacy Tech Scholar℠ may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, platform transition, or by operation of law.

No joint venture, partnership, employment, fiduciary, agency, school-student, college-student, or credentialing relationship is created by these Terms or your use of the Services.

38. Trademark Notice

Pharmacy Tech Scholar℠ and related names, logos, product names, and branding are trademarks or service marks of Pharmacy Tech Scholar℠ or its owner. Other names and marks belong to their respective owners. Use of PTCB or other third-party names is for identification and descriptive purposes only and does not imply endorsement, sponsorship, employment, certification, licensure, or state approval except as expressly stated.
